A title search is an assessment of all public, municipal, and other pertinent records to verify the legal owner of the land as well as to ensure that all issues with the title – such as prior liens or other legal attachments – have been, or will be, corrected by the time the title changes hands. The Aim of a Title Search

Title searches aim to determine if any of the following restrictions may apply to the title in question:

  • Owed taxes
  • Mechanic’s liens
  • Claims on the property
  • Mortgages
  • Other assessments that may need to be corrected or obligations that must be fulfilled before the title can change hands

Types of Title Searches

A full coverage search is usually performed in preparation for a title transaction. Full coverage searches usually seek to discover liens, easements, claims, ordinances, bankruptcy proceedings, and CC&Rs (covenants, conditions and restrictions).

There are also limited coverage searches, which are slightly less thorough, and usually performed for refinancing or loans involving equity. These typically only search for liens, and bankruptcy proceedings against the property owner.

There is a third, less official title search called a non-insured report. These are informational reports that go by other names, such as Lot Book Reports, Litigation Guarantee, Plat Certificate, and others. These types are used mainly in the division of a deceased person’s property or the subdivision of a property.
