What is a title?


The word title gets thrown around a lot in our line of work, but what is it? Each property has a deed. The one who holds the deed - whose name is listed on it - is the rightful and lawful owner of that property. This person holds title to the property. The title is not a physical document, but rather a term of legal possession.




What is title insurance?


Title insurance is an insurance policy that protects against any legal battles, property loss, or damage that may stem due to defects in the title. There are two types - owner’s policies and lender’s policies.




Do I need title insurance?


If you are financing the property through a lender, you will likely be required to purchase a lender’s title insurance policy. This protects the lender’s interest in the property in case any title defects arise. If required, the policy will be purchased in the amount of the mortgage. If you want to protect your own interests, you will need to purchase an owner’s policy. You are not required to do so, but it is highly recommended. It will protect you should you have to tend to legal battles or deal with property loss. Some title defects that may appear after the closing include: - Forgeries and fraudulent transactions - Undiscovered easements and encumbrances - Recording / clerical errors - Missing heirs It is important to note that a lender’s policy will not protect your interests and rights to the property.




What is escrow?


Escrow is another common term you will hear when buying a piece of property. Escrow refers to the legal process in which a third party - usually the title company - holds the funds of a transaction until all duties and obligations of both parties are fulfilled. Once the transaction has concluded, the funds will be released from escrow to the appropriate party.
